THESE TERMS OF SALE ARE AN AGREEMENT (“AGREEMENT”) BETWEEN YOU AND KIDS II, INC. TO PURCHASE THE ITEMS IN YOUR ORDER. PLEASE READ THIS AGREEMENT CAREFULLY. BY SUBMITTING YOUR ORDER (1) YOU AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, (2) YOU ARE CONSENTING TO ENTER INTO THIS AGREEMENT IN ELECTRONIC FORM, AND (3) YOUR CLICK SHALL CONSTITUTE YOUR ELECTRONIC SIGNATURE ACCEPTING THIS AGREEMENT.
If you do not wish to accept this agreement, you should not order any products through our website.
Orders and Acceptance
By submitting an order, you represent and warrant that all personal information you have entered for the order is valid.
We do not currently accept orders from all addresses for online and telesales. Kids II, Inc. only accepts orders shipping within the forty-eight (48) Contiguous United States, Hawaii, and Alaska. We do not accept orders that ship to US territories such as Puerto Rico, Guam, etc. or to post office boxes.
We are proud to accept orders shipping to our military APO/AFO addresses.
We will issue an email notifying you when your order has been shipped.
Order Cancellation/Change Policies
Your satisfaction is very important to us. As soon as you submit your order, we immediately begin processing your shipment. Therefore, once an order is submitted through the online store, we are unable to cancel or change it. All orders, however, may be returned following our return policy. Product Representation
We attempt to be as accurate as possible in representing our products online. However, we do not warrant that product descriptions or other content of our website are accurate, complete, reliable, current, or error-free. In an effort to provide the best products possible, we periodically make product modifications. Actual products may not be identical to items pictured.
Pricing
All prices on our website are listed in U.S. dollars. Prices do not include shipping or handling which shall be charged on all orders as applicable and will be indicated at the time of your order.
In the event a product is listed at an incorrect price due to typographical or other error, we have the right to refuse or cancel any orders placed for the products listed at the incorrect price whether or not the order has been confirmed or accepted and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we will issue a credit to your credit card account in the amount of the incorrect price.
Kids II, Inc. applies applicable sales tax to the order total based on shipping destination.
Lack of Availability
Kids II, Inc. makes a reasonable effort to provide correct inventory information on its website and through our telesales line. If an item you have ordered is not in stock after the order has been placed, we will call you at the phone number provided in your order submission.
Payment
All payments must be made by VISA, MasterCard, American Express, Visa debit card or MasterCard debit card. No other payment methods are currently accepted online or through our telesales lines. Your rights as a cardholder are governed by your card issuer agreement and not this Agreement. You agree to notify us within sixty (60) days after any discrepancy appears on your credit card statement or such discrepancy will be deemed waived. If we do not receive payment from your credit card issuer or its agent, you agree upon our demand to pay all amounts due. You are responsible for paying any use, value-added or other taxes imposed on your purchases. We will not be responsible for any unauthorized amounts billed to your credit card by a third party. We are proud to offer shipping to APO/AFO addresses.
Shipment and Delivery
Our goal is to process and ship your order on all available goods within one business day of receipt. For orders received on weekends and holidays your order will be processed within 24 hours after the next business day. An email notification that your order has been shipped along with a tracking number will be sent to you shortly after your order has been processed.
Shipments are made via commercial carrier. In most cases you can expect to receive your order within seven business days or less based upon the level of shipping service that you select.
Shipping and handling charges are based on the following factors:
- The value of your order.
- Size and destination of your order.
- Handling charges for order processing.
- Any zone surcharges that may be applied for either heavy or bulky items.
- The level of service for your shipment that you choose, i.e., Ground, Second Day, and Next Day service.
Excluding APO/FPO shipments, shipment is not available for delivery to a post office box and requires a standard street address.
We are proud to service our U.S. military customers by shipping to APO/FPO destinations. Please note however that to these destinations it may not be possible to predict shipping transit times.
Returns
As part of our ongoing commitment to our customers, all orders placed through http://www.kidsii.com/ or http://www.brightstarts.com/ (or our telesales line) have a 30 day return policy from receipt of merchandise. Due to health and safety concerns, merchandise may only be returned if it is in its original packaging, unused, un-opened (see product packaging example below) and accompanied by an official Kids II, Inc. return label and return form. Your credit card will be credited upon receipt and inspection approval of returned merchandise. If at time of inspection the merchandise condition does not comply with the Kids II, Inc. return policy, you will be notified of the return rejection. If rejected, Kids II, Inc. can return merchandise at your cost or destroy the product upon your request and authorization.
The refund will be equal to the cost of the merchandise and applicable tax only. The cost of all original and return shipping, as well as value added services costs, such as “Gift Bags” will not be reimbursed. We do not accept COD returns.
Gift Returns
If you received your product as a gift, approved returns will be credited to the original purchaser only.
Please note this return policy is only valid for merchandise purchased directly from http://www.kidsii.com/ or http://www.brightstarts.com/ and is not valid for goods purchased from retailer’s websites accessed via the “Where to Buy” links or other retail websites or store locations. Please contact those retailers directly for purchases not made through http://www.kidsii.com/ or http://www.brightstarts.com/.
Kids II, Inc. does not assume liability for damage or loss in return shipping.
Return Instructions
Before returning an item, you must contact us at 1-866-203-3212 (or in Georgia, please dial 678-597-1773), to obtain return authorization. Our hours of operation are Monday through Friday 8:00 am to 5:00 pm Eastern Standard Time (excluding US public holidays). Prior to contacting us, please be sure to have your Kids II, Inc. sales order number available as shown on the front of your packing slip. Our Customer Service Department will provide you with the required return label and form including your Return Material Authorization Number (RMA#) necessary to return product to Kids II, Inc. The RMA form is required for goods to be accepted for inspection into our returns processing center.
Below is an example of original packaging. This packaging can not be opened and/or removed.

- Have your Kids II, Inc. sales order number available (located on the front of your packing slip).
- Upon receipt of your return label and form (which will be sent to you via email or United States Postal Service), ship your return merchandise pre-paid to our returns processing center. For your own protection, we recommend that you send your return via a service that will provide you with traceability and insurance for your shipment should the package be lost in transit. Kids II, Inc. does not assume liability for loss or damage of return shipments.

Warranty
Kids II® is committed to making innovative, high quality products for babies and children. We warrant this product to be free from defects in material and workmanship existing at the time of manufacture for a period of one year from the date of initial purchase (sales receipt is required for proof of purchase). If any defect is discovered during the limited warranty period, we will, at our sole option, repair or replace your product at no cost to you.
This limited warranty does not cover claims resulting from misuse, failure to follow the instructions on installation, maintenance and use, abuse, alteration, involvement in an accident, and normal wear and tear. Electronic Communications
When you visit our website, place an order, or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on our website. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. Your consent to enter into this Agreement electronically covers the current transaction only. Future transactions will require additional consent. If you wish to have a copy of this Agreement in paper form and you are unable to print a copy on your own computer system, we will provide you with a paper copy at no charge if you contact our Consumer Service line at the number below.
Limitation of Liability
IN NO EVENT WILL WE BE LIABLE TO YOU FOR ANY INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM OR CONNECTED WITH THIS AGREEMENT OR YOUR USE OR THE PERFORMANCE OF ANY PRODUCT, REGARDLESS OF WHETHER WE KNOW OR HAVE REASON TO KNOW OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
IN NO EVENT WILL OUR LIABILITY FOR ANY CLAIM OF ANY KIND, WHETHER BASED IN CONTRACT, WARRANTY, TORT, STRICT LIABILITY OR OTHERWISE, FOR ANY LOSSES OR DAMAGES ARISING OUT OF, CONNECTED WITH, OR RESULTING FROM, THIS AGREEMENT OR THE PERFORMANCE OR BREACH THEREOF, OR ANY PRODUCT OR THE USE OR PERFORMANCE THEREOF, EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT.
Terms of Use and Severability
We provide our services to you subject to our Terms of Use, and your order and purchase are also subject to those terms which are incorporated herein. In the event of a conflict between our Terms of Use or Privacy Policy and these Terms of Sale, these Terms of Sale will control. We reserve the right to make changes to our site, policies, Terms of Use, Privacy Policy and these terms at any time. If any part, term or provision of these terms shall be held illegal, unenforceable or in conflict with any law of a federal, state or local government having jurisdiction over these terms, the validity of the remaining portion or portions shall not be affected thereby.
Choice of Law
These terms shall be governed by and construed in accordance with the laws of the state of Georgia, without giving effect to any principles of conflicts of law. You and us irrevocably consent to the exclusive jurisdiction of any state or federal court having jurisdiction located in Georgia in connection with any action arising out of or related to these terms of use or their subject matter and waive any objection based on lack of personal jurisdiction, place of residence, improper venue or forum non convenience in any such action.
